Ireland's Gambling Regulation Act: What Changes and When

The Gambling Regulation Act 2024 became law on 23 October 2024, but the date that matters for Irish betting operators is 5 February 2026.

That is when the Gambling Regulatory Authority of Ireland started accepting and processing licence applications and issuing licences for remote and in-person betting, according to the Department of Justice, Home Affairs and Migration. The gap between enactment and licensing captures how this statute actually works: the Oireachtas created the framework, and ministerial commencement orders switch it on in phases.

The Old Framework Is Being Replaced

The Act, No. 35 of 2024, establishes the Gambling Regulatory Authority of Ireland, in Irish Údarás Rialála Cearrbhachais na hÉireann. It gives that body responsibility for licensing and regulating betting, gaming, certain lotteries, and related products and services. The legal break is spelled out in the statute itself: it provides for the repeal of the Gaming Act 1744, the Betting Act 1853, the Totalisator Act 1929, the Betting Act 1931, the Gaming and Lotteries Act 1956, and certain other provisions. Enactment did not instantly erase that older legislation. The repeals also waited on commencement.

The Regulator and Its Main Tools

The Act creates more than a licensing body. It provides for a National Gambling Exclusion Register, a Social Impact Fund financed by contributions from certain licensees, and obligations on licensees covering advertising, inducements and sponsorship, aimed at safeguarding people who take part in gambling. It also prohibits children from participating in gambling or being employed in the gambling industry. Compliance and enforcement measures are built in to ensure that licence conditions and licensee obligations are met. A reader working from the statute alone could mistake these for live rules. They are statutory commitments whose start dates depend on further orders.

First Live Phase: 5 March 2025

The first commencement order, S.I. No. 57 of 2025, appointed 5 March 2025 as the day Part 1, Chapter 1 and Chapter 2 of Part 2, Part 3, and Chapter 3 of Part 4 came into operation, subject to exclusions in the order. The Irish Statute Book commencement table shows sections 1 to 5 and 11 to 14 commenced on that date. The Department of Justice, Home Affairs and Migration said on 4 March 2025 that the order established the Gambling Regulatory Authority of Ireland on a statutory basis and allowed it to become operational. It also approved the appointment of the Authority’s members.

5 February 2026: Betting Licences and Fines

The operational shift came with the order in force from 5 February 2026. The department’s 3 February 2026 statement said the GRAI could begin accepting and processing applications, and issuing licences, for remote and in-person betting operators. The same order commenced provisions amending and repealing existing gambling legislation. It also conferred investigative powers and authorised administrative sanctions of fines up to €20 million or 10% of a licensee’s turnover, whichever is greater. That is the point at which enforcement stopped being prospective. The released material confirms the opening for remote and in-person betting; it does not say every licence category opened that day.

What Still Waits, and Why the Sequence Matters

The National Gambling Exclusion Register and the Social Impact Fund are in the Act, but their operational dates are not fixed in the commencement material currently available. The advertising, inducement and sponsorship obligations, and the child-protection and employment prohibitions, are provided for in the statute; they become enforceable only as the relevant provisions are commenced and as the regulator issues guidance. A remote or in-person betting firm may now need a licence, but it cannot assume the full rulebook is alive simply because the Act says so.

For anyone watching Irish gambling law, the sequence is the story. Enacted in October 2024; regulator established and members approved on 5 March 2025; betting licence applications and the €20 million or 10% turnover penalty regime live from 5 February 2026. What remains open is the next set of commencement orders, especially for the exclusion register, the Social Impact Fund and the wider licence categories. A business asking what the Act changed should first ask which part of it has been switched on.
